Who pays the costs of the sale?
In Spain, the seller pays the municipal capital gains tax, income tax on the gain, the real estate commission, and mortgage cancellation costs if applicable. The buyer pays the transfer tax (or VAT for new builds), notary, registry, and management fees.
What is the municipal capital gains tax (plusvalía)?
It's a municipal tax on the increase in value of urban land from when you bought it to when you sell it. It's calculated on the cadastral value of the land (not the sale price). Since 2021, you can choose between the objective method and the real method, and pay whichever is more favourable.
How much income tax is paid on the sale?
Income tax applies to the capital gain (sale price minus purchase price and associated costs). The rates range from 19% to 28% in progressive brackets. If you reinvest in your primary residence, you may be exempt. Owners over 65 selling their primary residence are also exempt.
Can the commission be reduced?
The commission reflects the service you receive. An agency that charges less usually offers less: less marketing, less dedication, less negotiating power. What matters isn't how much you pay in commission, but how much net money you end up receiving. A good agent who negotiates 3-5% above the final price more than justifies their commission.
